Final Regulations Adopted for AB 1825—Mandatory Harassment Training Law

Despite legal protections, sexual harassment in the workplace remains a major economic and social problem in California, costing employers millions of dollars in litigation.  Last month, The Fair Employment and Housing Commission finalized regulations for California's mandatory harassment training law, AB 1825.  The new adoptions are designed to help employers take all reasonable steps to prevent harassment from occurring.

Summary of critical AB 1825 requirements:

• All California employers with 50 or more employees or contractors are required to provide at least two (2) hours of interactive sexual harassment training to all supervisory employees.

• All forms of training must involve a Subject Matter Expert who has "legal education coupled with practical experience, or substantial practical experience in training in harassment, discrimination, and retaliation prevention."  This means training providers you have used in the past may not comply with the new requirements.

• Your managers and supervisors are required take part in AB 1825 Harassment Training every other year.  For example, if your organization trained in 2005, your managers and supervisors must re-train again in 2007.

• All new managers and supervisors must be trained within six months of hire or promotion.
